DOL Releases Overtime Final Rule
The Department of Labor (DOL) has released the final Overtime rule, with an effective date of December 1, 2016. The Final Rule focuses primarily on updating the salary and compensation levels needed for Executive, Administrative and Professional workers to be exempt from the Fair Labor Standards Act (FLSA).

Home Care Rule Takes Effect
DOL’s Home Care Rule took effect on October 13. DOL will not engage in any enforcement activities until November 12. It is unclear what effect this will have on private actions taken during this time, but future compliance will involve meeting minimum wage and overtime liabilities back to October 13th. DOL will continue to offer “compliance assistance” to states.

Court Upholds Home Care Rule
The U.S. Court of Appeals has upheld the Department of Labor’s (DOL’s) rule that narrows the companionship exemption to the Fair Labor Standards Act. The three-judge panel affirmed both the third party prohibition and the new definition of companionship.
